Terms of Use, Safety, & Product Liability Disclaimer
By purchasing, deploying, or utilizing any hardware devices (including but not limited to the AP338, AP035, and AP4020 breathalyzers), Breath Alcohol Ignition Interlock Devices, Breath Alcohol Simulators, Alcohol Reference Solutions, or by accessing the Alcopatrol Internet of Things (IoT) Alcohol Monitoring web platform (collectively referred to as "the Products and Services") provided by Alcopatrol Inc., you acknowledge and agree to the following mandatory provisions:
1. Reference Readings & Limitation of Legal Liability
Environmental & Biological Variances: Users are explicitly notified that numerous external factors, including but not limited to residual gases in ambient air, cigarette/tobacco smoke, environmental hydrocarbons (such as industrial solvents, thinners, or alcohol-based sanitizers), and various food or chemical residues remaining in the human mouth—can fundamentally alter or skew Breath Alcohol Concentration (BAC) and Blood Alcohol Concentration (BAC) measurements.
No Legal Claims: Because of these unpredictable operating variables, all measurement data, indicators, reports, or printed receipts generated by -AlcoPatrol hardware are provided strictly for informational and screening purposes only.
Exclusion of Liability: To the maximum extent permitted by law, Alcopatrol Inc., its officers, directors, and affiliates assume no civil, criminal, financial, or legal liability whatsoever arising from the use of any device, the deployment of its test metrics, or any individual or corporate decisions made based on device readings.
Corporate Safety Policy: Alcopatrol Inc. stands behind an absolute zero-tolerance safety policy: “DO NOT drink before driving.” Our products must never be used to justify or calculate a "safe threshold" for operating any motor vehicle, commercial fleet, heavy machinery, or engaging in safety-critical tasks.
2. Strict Operating Protocols & Sensor Integrity
To ensure the performance and accurate operation of Alcopatrol Inc. fuel cell sensors, users across all product configurations must strictly comply with standard operating procedures:
The 15-Minute Protocol: Test subjects must completely abstain from eating, drinking, or smoking for a minimum of fifteen (15) minutes prior to delivering a breath sample. Residual mouth alcohol, aromatic beverages, mouthwashes, mouth sprays, medicines, or biological functions (such as burping or vomiting) will distort values and risk permanently poisoning or damaging the high-precision electrochemical/fuel cell sensor.
Cross-Contamination: Devices must not be operated if the administrator’s or user’s hands are wet with alcohol-based hand sanitizers, or in enclosed environments containing dense chemical vapors, as the immediate airflow intake can trigger false readings or degrade sensor life.
3. IoT Alcohol Monitoring Web Platform & Connectivity
Data Transmission: Certain Alcopatrol products utilize Wi-Fi, 4G, or Bluetooth connectivity to upload records to our IoT web platform. Alcopatrol Inc. does not guarantee uninterrupted or error-free transmission of data, as remote connectivity relies on third-party telecommunications networks.
Real-Time Data Disclaimer: While the monitoring platform provides real-time reporting and analytics for behavioral insight and compliance monitoring, it should not be solely relied upon as an absolute fail-safe for critical law enforcement or medical diagnostics.
4. Mandatory Recalibration & Technical Maintenance
Calibration Schedule: Professional-grade alcohol testing hardware undergoes natural sensitivity drift over time. To maintain optimal precision and performance, all Alcopatrol breathalyzers, ignition interlocks, and simulators must be professionally calibrated at prescribed intervals by an authorized Alcopatrol technician or service center. Failure to calibrate your equipment voids accuracy claims.
Tampering & Housing Seals: Hardware warranties apply exclusively to unmodified, factory-sealed units. Any evidence that causing screws have been unscrewed or loosened, that the official warranty label has been broken, or that servicing was attempted by unauthorized personnel will result in the immediate and total voiding of all product warranties.
5. Hardware Accessories & Electrical Safety
Approved Charging Elements: Users must only charge Alcopatrol rechargeable lines using power supply adapters and cables explicitly provided or approved by Alcopatrol Inc. Utilizing third-party, unapproved high-voltage blocks or cables poses severe risks, including electrical short-circuits, battery swelling, or electrical shocks.
Operational Constraints: Hardware units must never be operated to conduct a breath alcohol test while the internal battery is actively connected to a live charging power source.
